E-SIGN: Exceptions

Q: Does E-SIGN apply to all documents? A: No. E-SIGN specifically excludes wills, trusts, family law documents, court orders, and certain critical consumer notices [§ 7003].

Key rule (§ 7003(a)): E-SIGN does not apply to a contract or record to the extent it is governed by laws relating to wills, codicils, testamentary trusts, adoption, divorce, or other family law matters.

Rule: E-SIGN has carve-outs for documents where the consequences of error are severe or where paper requirements serve important protective purposes.
