Q: Who enforces the Consumer Rights Directive? A: Each Member State designates authorities to enforce the Directive. Penalties must be effective, proportionate and dissuasive [Art 23-24].

Key rule (Art 23): Member States shall ensure that adequate and effective means exist to ensure compliance with this Directive.

Rule: Each Member State sets its own enforcement mechanisms and penalties, but they must be effective and dissuasive. Directive 2019/2161 (Omnibus) strengthened penalties.
