## Enforcement and Penalties [Art 23-27]

**Q: Who enforces the Consumer Rights Directive?**
**A:** Each Member State designates authorities to enforce the Directive. Penalties must be **effective, proportionate and dissuasive** [Art 23-24].

**Key rule (Art 23):** Member States shall ensure that adequate and effective means exist to ensure compliance with this Directive.

**Rule:** Each Member State sets its own enforcement mechanisms and penalties, but they must be effective and dissuasive. Directive 2019/2161 (Omnibus) strengthened penalties.
