Regulation 22A: Direct marketing to corporate subscribers

Rule

Corporate subscribers (companies, LLPs, partnerships) have similar protections to individuals for electronic marketing.

You must not send unsolicited marketing emails to corporate subscribers if they have:

  • Registered with the Corporate Telephone Preference Service, OR
  • Previously objected to receiving marketing from you

A person shall neither transmit, nor instigate the transmission of, unsolicited communications for the purposes of direct marketing by means of electronic mail to a corporate subscriber unless— (a) the corporate subscriber has previously notified the sender that he consents to such communications being sent; or (b) the sender has obtained the contact details of the corporate subscriber in the course of the sale or negotiations for the sale…
